The judicial resolution follows the inclusion of a new official record corresponding to an elderly person who died in their home in Benetússer during the night of the flood. This decision was made following a report from the Public Prosecutor's Office that deemed it necessary to integrate this death into the main proceedings.
Although the forensic report did not establish a direct causal link between the flooding and the death, the magistrate determined the existence of a contemporary contributing factor. According to the resolution, the acute stress caused by the situation witnessed from the home led to an acute myocardial infarction.
With this action, the investigating judge has annulled the previous dismissal of private proceedings. The case is now unified within the main investigation coordinated by the court, which is looking into alleged crimes of homicide and reckless injury related to the management of the emergency.
