The five keys to the new rent regulation in Spain
Advance Tax & Legal, a firm specializing in legal, tax, and real estate advice, analyzes the main novelties of the October 2026 housing reform and its impact on landlords and tenants.
1. Greater protection and stability for contracts. The reform includes extraordinary extensions of up to two years for certain habitual residence rentals. Furthermore, a second regulation provides for extending ordinary extensions and strengthening guarantees against contract termination.
2. Limitation of rent increases. Annual rent adjustments are restricted until the end of 2027. When the rent exceeds the state reference index limit, it cannot be increased; in other cases, a limit of 2% is established in the absence of agreement.
3. Greater control of temporary and room rentals. Temporary contracts must respond to a real and verifiable need. Likewise, the sum of room rents is limited to prevent this modality from being used to circumvent residential rental regulations.
4. New tax incentives and obligations. Tax benefits are introduced to encourage affordable residential rentals, along with tax measures aimed at discouraging vacant properties and certain tourist uses.
5. Reinforcement of tenant guarantees. The regulations incorporate greater transparency requirements in real estate advertisements, protection measures against certain evictions, and new obligations for large property owners.
At Advance Tax & Legal, we highlight the importance of reviewing lease agreements and tax planning for real estate investments. The new regulation requires an individualized analysis to ensure legal certainty, prevent conflicts, and legitimately optimize the taxation of property owners and investors.
