The Ombudsman, Ángel Luna, has launched an investigation into the municipal license granted in Benissa for the luxury complex Patmore, after the Casal Cultural filed a complaint against the parcel segregation which, in their opinion, includes part of the Colada de Fanadix livestock trail.
The complaint, filed on May 5th, warned the council that the parcels affected a public path belonging to the Generalitat Valenciana, considered public domain. However, the City Council, governed by the PP, did not respond within the established deadline, prompting the Casal Cultural to appeal to the Ombudsman on July 31st.
The Ombudsman has accepted the complaint, considering that the council's inaction could violate the right to good administration. Therefore, it has demanded a detailed report from the City Council and an explanation for its silence regarding the complaint.
The Casal Cultural fears that if the Patmore works proceed as currently planned, it could lead to an illegal occupation of the livestock trail, with potential criminal and civil liabilities. The entity had already warned on February 10th, 2026, about errors in the mapping affecting the trail.
The Benissa City Council, chaired by Arturo Poquet, argues that at the time of granting the license, the official mapping did not indicate the livestock trail's impact. However, the maps were corrected in July, including the path within the future complex. The council has announced it will request a formal demarcation from the Ministry of Environment to determine the definitive route.
The Casal Cultural considers that the council's inaction, ignoring prior warnings and failing to respond to the complaint, constitutes a clear case of maladministration.
